By accessing or using the website and services provided by BudgetServers.com ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Use. If you do not agree to all of these terms, you may not access or use our services.

We reserve the right to modify these terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.

Services Description

BudgetServers.com provides virtual private server (VPS) hosting, dedicated server hosting, and related managed hosting services. Our services include but are not limited to:

  • Virtual Private Server (VPS) provisioning and management
  • Dedicated bare-metal server rental
  • Network bandwidth and connectivity
  • DDoS protection and mitigation
  • Technical support and server management assistance
  • Control panel access and server monitoring tools

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable prior notice where possible.

Account Responsibilities

When you create an account with us, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account
  • Ensure only authorised users access your account and services

You may not share your account credentials or transfer your account to another party without our prior written consent.

Acceptable Use Policy

You agree to use our services only for lawful purposes. The following activities are strictly prohibited:

  • Hosting, distributing, or transmitting illegal content of any kind
  • Sending unsolicited bulk email (spam) or operating open mail relays
  • Conducting or facilitating DDoS attacks, port scanning, or network intrusion
  • Mining cryptocurrency without explicit written permission
  • Hosting phishing sites, malware, botnets, or command-and-control servers
  • Violating the intellectual property rights of others
  • Distributing, storing, or transmitting child sexual abuse material (CSAM)
  • Using our infrastructure to violate any applicable local, national, or international law
  • Reselling our services without prior written authorisation
⚠ Zero Tolerance Policy Violations of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund. We will cooperate fully with law enforcement authorities regarding any illegal activities conducted using our infrastructure.

Billing & Payment

All fees are billed in advance on a monthly or annual basis as selected at signup. By providing payment information, you authorise us to charge the applicable fees.

  • Invoices are issued at the start of each billing cycle
  • Payment is due within 7 days of invoice date
  • Services may be suspended after 7 days of non-payment
  • Services will be terminated and data deleted after 14 days of non-payment
  • Reactivation fees may apply to suspended accounts
  • All prices are exclusive of applicable taxes unless stated otherwise

We reserve the right to change our pricing with 30 days' written notice. Price changes will not affect the current billing cycle.

Refund Policy

We offer a 7-day money-back guarantee on new VPS orders. Dedicated server orders are non-refundable once provisioned due to hardware reservation costs.

  • Refund requests must be submitted within 7 days of initial service activation
  • Refunds are not available for accounts terminated due to policy violations
  • Setup fees, if applicable, are non-refundable
  • Domain registration fees are non-refundable
  • Partial refunds for mid-cycle cancellations are issued at our discretion

Service Level Agreement (SLA)

We strive to maintain 99.9% network uptime for all services. Our SLA commitments are as follows:

  • Network uptime of 99.9% measured monthly, excluding scheduled maintenance
  • Scheduled maintenance will be announced at least 24 hours in advance
  • SLA credits are issued as service credit, not cash refunds
  • SLA credits do not apply to outages caused by customer actions, DDoS attacks beyond our mitigation capacity, or force majeure events
SLA credits: 99.0–99.9% uptime = 5% credit | 95.0–99.0% = 10% credit | Below 95% = 25% credit

Data & Backups

You are solely responsible for maintaining backups of your data. While we may offer backup services as an add-on, we do not guarantee the integrity or availability of any backup unless explicitly stated in your service agreement.

  • We strongly recommend maintaining your own off-site backups at all times
  • We are not liable for data loss resulting from hardware failure, human error, or any other cause
  • Upon account termination, all data may be permanently deleted within 14 days

Intellectual Property

All content on the BudgetServers.com website, including text, graphics, logos, and software, is the property of BudgetServers.com or its content suppliers and is protected by applicable intellectual property laws.

You retain full ownership of all content and data you store on our servers. By using our services, you grant us a limited licence to store and process your data solely for the purpose of providing the services.

Limitation of Liability

To the maximum extent permitted by applicable law, BudgetServers.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss or corruption of data
  • Cost of substitute services
  • Service interruption or downtime
Liability Cap Our total liability to you for any claim arising out of or in connection with our services shall not exceed the total amount paid by you for the service in the three (3) months preceding the event giving rise to the claim.

Termination

Either party may terminate services at any time. You may cancel your account via the client portal or by contacting our billing team. We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms of Use or the Acceptable Use Policy
  • Non-payment of fees
  • Fraudulent or illegal activity
  • Actions that harm our network, infrastructure, or other customers

Upon termination, your right to use our services ceases immediately. Sections relating to intellectual property, limitation of liability, and dispute resolution survive termination.

Governing Law & Disputes

These Terms of Use shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or the use of our services shall first be attempted to be resolved through good-faith negotiation.

If a dispute cannot be resolved informally, it shall be submitted to binding arbitration before resorting to litigation, except where injunctive relief is sought to prevent irreparable harm.
